TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THERAPACT, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOSS OF DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.[cite: 2]

Liability Cap: In no event shall Therapact’s total cumulative liability to you for any and all claims exceed the total amount paid by you to Therapact in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred US dollars ($100.00), whichever is greater.[cite: 2]
